Order of the National Green Tribunal regarding commercial activities going on in residential areas, Nai Sadak, Delhi, 25/01/2022
Order of the National Green Tribunal in the matter of Rajeev Aggarwal Vs North Delhi Municipal Corporation & Others dated 25/01/2022.
The complaint of the applicant is that factories and commercial activities impermissible in residential areas of Nai Sadak, Delhi is going on in violation of environmental norms. Taking cognizance of the said complaint, Tribunal passed an order, August 23, 2021 wherein the NGT directed the appointment of a Monitoring Committee to undertake study of the situation and remedial measures required.
The report of DPCC states that the ten premises mentioned by the applicant in the original application were inspected by joint Committee and they found that in three places, impermissible activities were going on and those premises have been sealed. In respect of remaining premises, it is said that either they are vacant or small shops with permissible activities are running.
The reports by the Monitoring Committee and the Deputy Commissioner of Police also mentioned that show cause notices proposing environmental compensation of Rs. 2 lakhs on each violator have been issued by the DPCC and further action is still in process. Further, no objection has been filed by the applicant to the said reports pointing out any discrepancy in the said reports.
Therefore, the NGT accepted the reports and directed the concerned authorities to ensure recovery of environmental compensation from the concerned violators expeditiously and in any case, not later than three months.
