Order of the National Green Tribunal regarding damage to Yamuna floodplains due to holding of World Culture Festival, 09/05/2017
Order of the National Green Tribunal in the matter of Manoj Misra Vs. Delhi Development Authority & Others dated 09/05/2017 regarding rejuvenation of the Yamuna river and biodiversity.
The highlights of the case discussed in the Court were the following:
- Counsel appearing for the Ministry of Water Resources submits that the event was held on the flood plan and it was so permitted only on the statement of Art of Living Foundation that they would pay all the amount that would be required to be paid for rejuvenation and restoration of the site.
- The Counsel appearing for NCT Delhi and Delhi Pollution Control Committee submits that they were not involved in grant of any permission and it was for Delhi Development Authority to look after the same. The NCT Delhi and Delhi Pollution Control Committee had only given NOC on behalf of the police to handle law and order and to ensure safety of the people participating. They are not liable for any compensation or penalty.
