Order of the Supreme Court of India regarding Delhi Jal Board permission for use of 1.6 acres of forest land falling in Sanjay Van, 10/04/2018

Order of the Supreme Court of India in the matter of In Re: T. N. Godavarman Thirumulpad Vs Union of India & Others dated 10/04/2018. This is an application filed by the Delhi Jal Board seeking permission for use of 1.6 acres of forest land falling in Sanjay Van which is part of the South Central Ridge area in Delhi to lay 600 MM diameter water pipeline from IIT Gate to Qutab pumping station passing through Sanjay Van for a distance of 1200 meters and which pipeline is the main inlet water carrying pipeline for improvement of the water supply in the Mehrauli Area.

The report submitted by CEC has given a site specific recommendation which states that as the water pipeline project is in public interest and will benefit about 1.75 lakh residents of the area CEC recommends the Apex Court to consider permitting Delhi Jal Board to use 1.6 acres forest land in Sanjay Van on the condition that :

i) Delhi Jal Board will obtain clearance under Section 2 of the Forest (Conservation) Act, 1980

ii) DJB shall deposit 5% of the sanctioned project cost with the Ridge Management Board Fund which shall be used by the Delhi Forest Department for conservation and development of Delhi Ridge.

Supreme Court accepts the report of the CEC.
