Order of the Supreme Court of India regarding mining leases falling under forest land, Karnataka, 24/01/2019

Order of the Supreme Court of India in the matter of Samaj Parivartana Samudaya & Others Vs State of Karnataka & Others dated 24/01/2019. The issue in these applications is whether the leased areas of the lessees in question fall within the Revenue land or Forest land. The High Court of Karnataka in its order dated 16/11/2018 sets aside the notifications under the Karnataka Forest Act, 1963, dated 4.8.1994 and 4.9.2014 which according to the State of Karnataka go in support of the claim of the lessees to allow them to commence mining in the leased areas.

The Government of Karnataka through its counsel has said that the State is proposing to challenge the judgment and order of the High Court before the Apex Court and has asked for four weeks time. Supreme Court adjourns the hearing of the applications, which would be taken up once the special leave petition filed by the State of Karnataka comes up before the Court.
