Order of the Supreme Court in the matter of Islampur Municipal Council Vs Madhukar Shankar Sutar & Others dated 16/01/2024.

The Supreme Court expressed its dissatisfaction with the affidavit of compliance filed by the Islampur Municipal Council pursuant to the order of October 3, 2023. The SC noted that "basic facts such as average daily generation of solid waste in the municipal limits have not been set". Even the capacity of MSW referred to in the affidavit has not been set out.

The SC directed the municipal council to state what efforts it has made after April 28, 2021 for getting the authorisation from the Maharashtra Pollution Control Board. The court granted one months time to Islampur Municipal Council to file a better affidavit along with all the material particulars and listed the matter for March 7, 2024.

The SC also directed fresh notice to be issued to the Maharashtra Pollution Control Board.

The SC in its order of October 3, 2023 had directed the Chief Officer of the Islampur Municipal Council to file an affidavit setting out the compliance, if any, made with the Solid Waste Management Rules, 2016 and was also asked to state the preventive measures being taken to ensure that untreated sewage water is not discharged in Krishna river.
