Insecticides (Second Amendment) Rules, 2022
The Ministry of Agriculture and Farmers Welfare on 24th November 2022, published the Insecticides (Second Amendment) Rules, 2022 to further amend the Insecticides Rules, 1971. The amendment is brought under rule 9 which deals with licenses to manufacture insecticides in which after sub-rule 3(iii) the following has been notified: 3(iii): If the licensee wants to undertake during the currency of the licence to manufacture for sale of additional insecticides, he shall apply to the licensing officer for the necessary endorsement in the licence on payment of the prescribed fee for every category of insecticides. “Provided that the licensing officer shall inspect the manufacturing premises within six months from the date of endorsement of additional insecticide on license to satisfy itself that necessary plant and machinery, safety devices and first aid facilities and the like, exist in the premises where insecticide is proposed to be manufactured.” Further a new rule 10(E) which deals with Sale of Insecticides through e-commerce entity has been notified as follows: A licensee, during the currency of license, may undertake sale of any insecticide through e-commerce entity for supply of insecticides to the door step of the farmers and the licensee shall comply with the provisions of the Act and the rules made there under for the time being in force: Provided that the operators of e-commerce entity before engaging the licensee for sale of insecticide through online portal, shall verify the validity of the licence issued by the concerned Licensing Officer of the State: Provided further that the operators of e-commerce entity and licensee shall comply with the provisions of the Consumer Protection (E-commerce) Rules, 2020.
