They were emitting highly polluting ambient air quality in the area in question.

The Applicant’s case is that the untreated effluents are being released by the Industry on the land and to the pond situated on the back side of the factory area- UPSIIDC Wide Park Land. NGT directs a team of officials accompanied by Additional Director of CPCB to visit the factory premises and collect soil samples.
