The area falls within the buffer zone of the East Calcutta wetland. It is alleged that several temporary bamboo structures with wooden platforms in the form of mesh have been put up on the water-body where various social events and functions are organized and held regularly.

The order of the National Green Tribunal (Eastern Bench, Kolkata) in the matter of Subhas Dutta Vs. State of West Bengal & Ors. dated 27/11/2014 regarding discharge of fly ash into Chandrabhaga and Bakreswar rivers by Bakreswar Thermal Power Project.

The Tribunal noted that the report filed by the Member Secretary, West Bengal State Pollution Control Board and the Chief Secretary, Govt. of West Bengal clearly indicates that a huge quantity of fly ash in the river bed has accumulated due to discharge of fly ash laden water and the same has not yet been removed.

Order of the National Green Tribunal (Principal Bench, New Delhi) in the matter of Subhas Dutta Vs. Union of India & Ors dated 28/08/2014 regarding idol immersion. The Tribunal has noted that the affidavit filed on behalf of the Central Pollution Control Board has stated that the guidelines in relation to Idol immersion in the various parts of the country have been finalised and guidelines earlier prepared for Idol immersion in 2010 will be amended and issued to all the State Boards and the State Governments.

The Applicant has stated that because of the continued emission of air pollutants to the
atmosphere and discharge of waste water to the canal called Noai canal, the health condition of the people residing in the area are adversely affected.
