Order of the National Green Tribunal regarding dumping of construction waste in forest area in the course of constructing a road from Itharna to Kukhai located in district Tehri-Garhwal and Dehradun, 11/01/2023
Order of the National Green Tribunal in the matter of Sudhir Joshi Vs State of Uttarakhand dated 11/01/2023.
An application was filed before the NGT by Sudhir Joshi, Adhayakasha, Jaiv Vividha Prapandhan Samiti Gram Panchayal, village Baagi, P.O. Bhogpur, district Dehradun, Uttarakhand.
The complaint is that during construction of 12 kms road from Itharna to Kukhai, located in District Tehri-Garhwal and Dehradun, construction waste (muck and debris) has been dumped in the forest area damaging Banjh Tree forest. The illegal and unscientific of debris reaches down to river Jakhan which is a tributary to river Ganga and due to continuous deposition of debris in river Jakhan, a temporary lake has been formed near Shambhuwala village. The above activities are causing huge damage to the environment and hazards to public health in general in the nearby areas.
The NGT directed the constitution of a joint committee to look into the matter and submit a report within two months.
