Order of the National Green Tribunal in the matter of Dr. Arun Kumar Sharma Vs Ministry of Environment Forests & Climate Change & Others dated 10/03/2021.

The application challenges the Zonal Master Plan, 2030 (ZMP 2030) for the Mount Abu Eco-sensitive Zone (ESZ).

The impugned ZMP 2030 was notified on October 29, 2015 after approval by the Ministry of Environment, Forest and Climate Change (MoEF&CC) September 28, 2015. The petitions challenged the same as being inconsistent with the ESZ notification June 25, 2009.

The issue for consideration is the remedial steps for protection of ecology of Western Ghats, which is an eco-sensitive area. The NGT observed that there was demand for more and more exclusion by those who claim the need for ‘development’ while need for ‘environment protection’ does not allow acceptance of such demands. This aspect needed to be finalized and had been pending consideration for the last eight years.

Order of the National Green Tribunal in the matter of Bombay Environment Action Group Vs Union of India & Others dated 09/01/2020. The bench of Justice S. P. Wangdi took up the matter of Zonal Master Plan drafted by the Mumbai Metropolitan Region Development Authority (MMRDA).

Union of India & Ors.) dated 13/12/2019 on the issue of Hindustan Institute of Technology & Management, Agra (HIT) and Anand Engineering College, Agra (AEC) falls within the Soor Sarovar Bird Sanctuary.

Order of the National Green Tribunal in the matter of Vinaykumar Vithalrao Jatha Vs State of Maharashtra & Others dated 05/12/2019 regarding establishment of a 26 MW Co-generation unit on a land bearing Gut No. 52/2 in village Limpangaon, Taluk Shrigonda, District Ahmednagar, Maharashtra on the ground that the project falls within the Eco-Sensitive Zone (ESZ) of the Great Indian Bustard Sanctuary. Also, the land (Gut No. 52/2) is a forest land which cannot be diverted for non-forest activity without clearance under the Forest (Conservation) Act, 1980.

Order of the National Green Tribunal in the matter of Bhagwan Bhoite & Others Vs The Collector, Ahmednagar & Others dated 01/10/2019 regarding severe air pollution due to operation of a stone crusher unit in village Ghutewadi, Taluka Shrigonda, District Ahmednagar run by M/s. Dineschandra R. Agarwal Infracon Pvt. Ltd. It is alleged that the plant is run mostly at night and is located near to a school and agricultural lands. Apart from this, the unit is stated to fall within the limits of the Eco-Sensitive Zone (ESZ) of Great Indian Bustard Sanctuary.

Order of the National Green Tribunal in the matter of D. V. Girish Vs Union of India & Others dated 25/09/2019. Two applications related to each other are taken up for hearing by the Tribunal. The first one deals with preservation of Chikmagalur district from the impacts of tourism.
