Grievance in the application is against Shah Sponge Iron & Power Ltd., Khaparsar Juri (Hata), situated in East Singhbhum District of Jharkhand which is causing water pollution (as dust particles are found in water bodies), air pollution (as the dust covers the surface of cultivable land as well as on the leaves of the trees planted by the company and grassland) and is also adversely affecting the biodiversity of the area and also the health of the nearby residents.

Report by HIL Limited in the matter of Kalyan Bansingh & Others Vs HIL Limited & Others dated 29/09/2020. HIL stated that the Department of Mines & Geology, Government of Jharkhand compliance report of August 9, 2020 had proceeded on an incorrect and baseless assumption that safety measures for restitution of the asbestos mines in Roro hills, Chaibasa, West Singhbum - to mitigate environmental and health impact were not taken.

Compliance report of National Green Tribunal order of January 07, 2020 by the state government of Jharkhand. The issue for consideration was the steps for restitution of the area which was earlier under the RORO asbestos mines, Chaibasa, West Singhbhum district. Lease for such mines was given in favour of Hyderabad Asbestos Cement Product Limited (HACPL). The mines stopped working in the year 1983. However, safety measures for restitution of the mines to mitigate adverse environmental and health impact in the area were not taken.

Order of the National Green Tribunal in the matter of Kalyan Bansingh & Ors. Vs. HIL Ltd. & Ors. dated 05/01/2016 regarding compensation for the loss sustained by the Applicants on account of asbestos mining carried out by the Respondent No. 1 i.e. HIL Ltd. besides seeking restitution/closure of abandoned asbestos mines at Village Roro, West Singhbhum, Jharkhand.

Pleadings are complete. However, the question of restitution of abandon asbestos mines can be resolved effectively upon getting the report of Joint Inspection Team from the State of Jharkhand ruled the Court.
