History of the Case: 

The issue for consideration is compliance of the judgment by the Supreme Court in M.C. Mehta vs. Union of India & Ors: (2004) directing shifting/closing of industrial activities falling under category ‘F’ of the Master Plan of Delhi, 2001. Aggrieved by the inaction of the authorities on the subject, petitions were filed in the Delhi High Court alleging that unauthorized industrial activities which included handling of plastic and its illegal disposal by way of burning, etc. were continuing. The proceedings were transferred to the Tribunal. 

Order of the National Green Tribunal in the matter of Satish Kumar Vs. Union of India & Ors. dated 29/07/2016 regarding illegal dumping of plastic waste, Village Nilothi, Delhi. The applicant, owner of the property-Plot no. 20/6, Village Nilothi, Delhi has moved this application for desealing the property on the grounds that he has removed all scrap materials lying outside the property in question and the property is lying vacant and he shall not use it for any plastic waste business or anything prohibited by the law.

Order of the National Green Tribunal (Principal Bench, New Delhi) in the matter of Satish Kumar Vs. Union of India & Ors. dated 23/07/2015 regarding illegal dumping of plastic waste and burning, Delhi.

The Transport Department of NCT of Delhi/Traffic Police and with the help of concerned SDM shall regulate/check the illegal movement of trucks containing plastics waste and transportation from other States entering in the Territory of Delhi and selling it to the unregistered plastics waste processors/segregators on the unauthorized plot/agricultural lands.

Order of the National Green Tribunal in the matter of Satish Kumar Vs. Union of India & Ors. dated 23/02/2015 regarding unregulated open burning of plastic/rubber or such other articles anywhere in India.

Order of National Green Tribunal in the matter of Satish Kumar Vs. Union of India & Ors. And Mahavir Singh Vs. Union of India & Ors. dated 24/11/2014 regarding polluting units of Delhi. The Tribunal has directed the DPCC, NCT of Delhi, North Municipal Corporation of Delhi to issue Notice to 177 Units which are defaulting and polluting units. NGT also said that "notice should state as to why they be not directed to be close permanently and pay compensation for restoration of the degraded environment resulting from their activities."
