Order of the National Green Tribunal in the matter of Rajendra Singh Versus Ministry of Environment, Forests and Climate Change & Others dated 25/03/2021.

The matter related to grant of mining leases without preparation of District Survey Report (DSR) as per the Sustainable Sand Management Guidelines (SSMG), 2016 and the Enforcement & Monitoring Guidelines for Sand Mining (EMGSM), 2020 in the district Banda, Uttar Pradesh. It is stated that an advertisement dated February 8, 2021 was issued for grant of mining leases without replenishment and carrying capacity studies.

The Ministry of Mines has issued the Minerals (Other than Atomic and Hydro Carbons Energy Mineral) Concession (Amendment) Rules, 2021 to further amend the Minerals (Other than Atomic and Hydro Carbons Energy Mineral) Concession Rules, 2016.

The Lok Sabha, passed the Mines and Minerals (Development and Regulation) Amendment bill 2021 on March 19, 2021. The bill was passed through a voice vote. The Bill seeks to amend the Minerals (Development and Regulation) Act 1957 and provide for the removal of the distinction between captive and merchant mines.

Order of the National Green Tribunal in the matter of Harivansh Yadav Vs Union of India & Others dated 17/03/2021. Prayer in the application was to restrain M/s Singh & Giri Infrastructure Pvt. Ltd. from doing mining in West Champaran district in Bihar on the banks of rivers Gandak, Bansi (tributary of Gandak), Bhuraha, Harbora, Masan, Jhikrauli, Koshil, Harha, Dwar-Da, Kathan, Pandee and Uria (all tributaries of Budhi Gandak).

Order of the National Green Tribunal in the matter of Agnes Kharshing Vs State of Meghalaya dated 17/03/2021. Grievance in the application was against the illegal mining of coal by cement companies at East Jaintia Hills district, Meghalaya. Case set out in the application was that the cement plants in question were undertaking mining causing pollution to Lukha and Lunar rivers resulting in death of fishes.

The Mines and Minerals (Development and Regulation) Amendment Bill 2021 was introduced in the Lok Sabha on 15 March, 2021. Coal Minister Pralhad Joshi introduced the Bill which amends the Minerals (Development and Regulation) Act 1957. The legislation seeks to remove the distinction between captive and merchant mines.

Order of the National Green Tribunal in the matter of Threat to life arising out of coal mining in south garo hills district Vs State of Meghalaya & Others dated 15/03/2021. The matter related to unscientific rat hole mining in Meghalaya and directions for preventive and remedial action.
