The matter related to illegal mining in the area of Lidhorahat Ghat Badtua in district Sagar, Madhya Pradesh. The bench of Justice Sheo Kumar Singh and Expert Member Satyawan Singh Garbyal of the NGT directed that there must be an institutional framework and enforcement mechanism to prevent illegal and excess quarrying. Further, the state should ensure that mining takes place without any adverse impact on the environment.

The applicant (Dheeraj Sharma) said that in spite of the notification issued by the Central Government and in spite of the fact that there is a regulatory authority to control illegal sand mining, it was taking place for government purposes.

Order of the National Green Tribunal in the matter of Rupesh Pethe Vs State of Madhya Pradesh & Others dated 26/07/2019. The Principal Secretary, Mineral Resources, Madhya Pradesh was directed by the NGT to file an affidavit to explain how mining leases were being granted in violation of law. The Tribunal said the state can permit mining only after Environment Management Plan has been approved by the State Environment Impact Assessment Authority (SEIAA).

Order of the National Green Tribunal in the matter of Nityanand Mishra Vs State of Madhya Pradesh & Others dated 04/07/2019 regarding conservation of Son Gharial Sanctuary. The NGT in its previous order had directed the state of Madhya Pradesh to take immediate steps for implementing the Action Plan, as recommended by the committee constituted for conservation of the sanctuary and submit a report.
