Affidavit filed by the 5th applicant pursuant to the direction of the National Green Tribunal dated 13/03/2023 in Original Application No. 442/2013.

A number of application's were filed by residents of Brahmapuram, Ernakulam district right from 2012 for the closing down of Brahmapuram waste disposal facility. In addition, they requested for appropriate remedial measures to restore the area of Brahmapuram waste disposal facility to its original state as far as possible.

Grievance in the application is against failure of the Gram Panchayat Gurgawan, block Tilhar, district Shahjahanpur, Uttar Pradesh to scientifically manage wet and dry waste as well as waste from veterinary hospital. Further, it was alleged that such waste was burnt to the detriment of environment.

There are a total of 16 legacy waste dumpsites in the state and 263641 tonnes of legacy waste has been dumped at dumpsites. Around 83311.28 tonnes of legacy waste has been cleared from the dumpsites.

Two legacy waste dumpsites at Sunder Nagar and Sarkaghat have been cleared and in 14 legacy dumpsites bio mining has started. The state of Himachal Pradesh has set the time frame for clearing all legacy dumpsites by December 2023.

In Goa, where sewer network is not available, septic-tank-soak-pit arrangement is adopted. Many hotels and residential buildings (50 rooms and above) have their own treatment plant (as mandated under the TCP Act 2010). Sulabh toilets are provided for group of houses and bio toilets have been provided under open defecation free (ODF) policy in the state.

The matter related to monitoring of waste in terms of Supreme Court orders dated September 2, 2014 and February 22, 2017.

The Chief Secretary, Gujarat accepted the fact that there was a gap of about 1005 MLD in sewage generation and treatment and legacy waste of 255 Lakh MT as well as 1452 TPD of unprocessed waste.

Order of the Supreme Court of India in the matter of Municipal Corporation, Ghaziabad Vs Central Pollution Control Board & Others dated 06/02/2023.

The Supreme Court directed Ghaziabad Development Authority to make payment of Rs. 1,04,20,000 for disposal of legacy waste dumped from the period October 21, 2020 to March 31, 2022. The amount, if not already paid has to be paid by the GDA to the Municipal Corporation, Ghaziabad within a period of one month.

The matter related to pollution of Banganga river at Katra due to dumping of waste.

Legacy waste dumped on the banks of Banganga rivulet has been removed completely and the site is totally clean. The Shrine Board has removed about 1500 MTs of waste dumped on the banks of river Banganga.
