Judgment of the National Green Tribual dated 07/02/2023 in the matter of Mahakar Singh Vs State of Uttar Pradesh & Others.

Action taken report by the Uttar Pradesh Pollution Control Board on the operation of 9 cold storages in tehsil Sadabad, Hathras district of Uttar Pradesh. During the visit, one of the cold storage units was not in operational condition and found closed. The other 8 cold storage facilities were found in operational condition.

The National Green Tribunal directed the Central Pollution Control Board (CPCB) to verify whether adequate steps have been taken to stop the flow of sewage and other wastes flowing into the storm water drain of  Ghaziabad Nagar Nigam. Ghaziabad Nagar Nigam informed the Additional Chief Secretary, Urban Development, Lucknow that there is now connectivity of wash waters and waste from dairies at three vulnerable points. 158 houses which were unconnected to the sewerage system has now been connected and hence no sewage is now being discharged into the drain.

Grievance raised by Rama Shanker Awasthi was in respect of operation of captive and thermal power plants by M/s Bajaj Hindustan Limited and M/s Bajaj Energy Limited at Lakhimpur Kheri, Uttar Pradesh in violation of environmental norms.

Order of the National Green Tribunal in the matter of Devanshu Bose Vs Agra Development Authority & Others dated 18/01/2023.

Grievance in the application is against failure of the state authorities to prevent discharge of sewage on open land from ‘Nalanda Town’, a housing colony developed by a builder at Shamshabad Road area of Agra, Uttar Pradesh. Sewage is estimated to be 1.45 lakh litres per day. Agra Development Authority (ADA) is primarily responsible for such failure, the complaint said.

Grievance in the application is that despite directlng stopping of illegal mining in Shamli and Saharanpur districts and recovering compensation, illegal mining was still continuing and compensation was not being recovered.

The matter relates to raising of illegal construction at Gata No. 345/1, area 345 sq. mtr, which is a part of flood plain of river Ramganga by M/s Torrent Gas Pvt. Ltd. Any construction on the flood plain zone of the river which is tributary of river Ganga is prohibited, the complainant, Adesh Kumar Yadav pointed out in his application before the NGT.
