Order of the National Green Tribunal in the matter of Satish Kumar Vs Union of India & Others dated 05/08/2019 regarding compliance of the judgment by Supreme directing shifting/closing of industrial activities falling under category ‘F’ of the Master Plan of Delhi, 2001.

History of the Case: 

Order of the National Green Tribunal in the matter of Central Pollution Control Board Vs State of Andaman & Nicobar & Others dated 22/07/2019 regarding implementation of Plastic Waste Management Rules, 2016 (PWM Rules) and directions issued by the CPCB on 30.06.2016 to implement the thickness norms for carry bags, constitution of squads for vigilance, preventing littering of plastic waste in public, submission of annual reports and action plan for management, quantification and characterization in every city/town of all the States/UTs.

Order of the National Green Tribunal in the matter of Ashwani Kumar Dubey Vs Union of India & Others dated 19/07/2019. The matter of discussion was the Report of the Committee in O.A 164/2018 with I.A. No. 155/2019 for direction dispensing the implementation of the Core Committee’s Recommendation. I.A. No. 337/2019 for permitting the applicant to continue to transport coal by road & I.A. No. 384/2019 for quashing the recommendation of the Core Committee.

The issue for consideration is compliance of the judgment by the Supreme Court in M.C. Mehta vs. Union of India & Ors: (2004) directing shifting/closing of industrial activities falling under category ‘F’ of the Master Plan of Delhi, 2001. Aggrieved by the inaction of the authorities on the subject, petitions were filed in the Delhi High Court alleging that unauthorized industrial activities which included handling of plastic and its illegal disposal by way of burning, etc. were continuing. The proceedings were transferred to the Tribunal. 

Order of the National Green Tribunal in the matter of Shailesh Singh Vs Sheela Hospital & Trauma Centre, Shahjahanpur & Others dated 15/07/2019 regarding non - compliance of the provisions of Bio-medical Waste Management Rules, 2016 (BMW Rules) by the States and UTs.

Order of the National Green Tribunal in the matter of Ashok Kumar Patjoshi Vs Ministry of Environment, Forest & Climate Change & Others dated 11/07/2019 regarding scientific disposal of Spent Pot Lining (SPL) which is produced by the smelting plants operated by the aluminum industries which contains high level of Cyanide and Fluoride which are carcinogenic and needs to be scientifically utilized/detoxified.

Order of the National Green Tribunal in the matter of Zumbarlal Dnyanoba Murkute Vs Dr. Nitin Virsingh Daliya & Others dated 04/07/2019 regarding illegal discharge of untreated effluents by Nityanand Institute of Medical Science while running a hospital, resort and party hall. It has been alleged that there is no proper waste management arrangement and untreated effluent was continuously being discharged causing massive damage to the environment. The report submitted by Maharashtra Pollution Control Board (MPCB) reveals environmental non-compliances.
