Judgement of the National Green Tribunal (Western Zone Bench, Pune) in the matter of Goa Foundation Vs Goa State Infrastructure Development Corporation & Others dated 07/04/2016. This Application is filed on 9th August, 2015, seeking prayers to enforce compliance with the requirement of EIA Notification, 2006 and CRZ Notification 2011 with regard to the construction of the 3rd bridge across River Mandovi in Goa which is alleged being constructed without necessary Environmental Clearance (EC), environmental studies, environmental management plan or other environmental safeguards.

The Supreme Court have held that the deemed mining leases of the lessees in Goa expired on 22.11.1987 and the maximum period (20 years) of renewal of the deemed mining leases in Goa has
also expired on 22.11.2007, mining by the lessees in Goa after 22.11.2007 was illegal.

Judgement of the National Green Tribunal (Western Zone Bench, Pune) in the matter of Goa Foundation Vs State of Goa & Others dated 30/07/2014 regarding the issue of setting the criteria for identification of forests in the State of Goa and implementation.

The National Green Tribunal has said that it is no longer mandatory for the Ministry of Environment and Forests (MoEF) to refer to Gadgil panel’s report while deciding applications for clearance for projects in permissible areas of the western ghats.

The Ministry of Environment and Forests (MoEF) was pulled up by the National Green Tribunal for not filing its final report on recommendations of the Madhav Gadgil report and Kasturirangan report on ecological significance of the Western Ghats. It also imposed a fine of Rs 25,000 on MoEF for failing to file the report despite being given four weeks time on August 30, 2013. Read text of this court order.
