Judgement of the National Green Tribunal in the matter of Society for Preservation of Kasauli and its Environs Vs Bird’s View Resort & Others dated 30/05/2017 regarding unauthorized construction of hotels in close vicinity of Kasauli area in the State of Himachal Pradesh. It was brought before the notice of the court that there are instances where plans were sanctioned for a limited purpose but they have been flagrantly violated, for instance, where 7 rooms were sanctioned, 50 rooms have been constructed.

Nilgiri Hotel & Others dated 26/05/2017 regarding unauthorized construction in Kasauli, Himachal Pradesh. NGT noted that even though Hotel Devshikha was granted consent to operate no inspection was conducted by SPCB. NGT expressed its displeasure at the report submitted by the Junior Engineer of the State Pollution Control Board and said that the report is primarily prepared for convenience of the hotel.

By order dated 10.2.2017, NGT had directed the Meghalaya State PCB to verify the claim of these hotels that they had complied with the directions of the Board. National Green Tribunal directs a team to be constituted which shall submit a report with regard to the various hotels and other institutions existing in Mount Abu with regard to measures taken by them for treatment of sewage including setting up of STP and their out flow from the institution into the Nakki lake.
