Grievance in the application is against failure of the state authorities to prevent discharge of sewage on open land from ‘Nalanda Town’, a housing colony developed by a builder at Shamshabad Road area of Agra, Uttar Pradesh. Sewage is estimated to be 1.45 lakh litres per day. Agra Development Authority (ADA) is primarily responsible for such failure, the complaint said.

The NGT, December 6, 2022 directed a committee to be constituted to look into the matter of lack of green belt and sewage treatment plant in Sidhharth Vihar Yojna, a scheme of Awas Vikas Parishad, Ghaziabad, Uttar Pradesh. The committee has to submit a report within one month, the court said.

Grievance raised by the applicants is that there is illegal extraction of ground water by the builders operating in Noida According to the applicants, the authorities have failed to prevent illegal extraction of ground water for commercial purposes resulting in depletion of ground water level in the area identified as ‘overexploited’ as per assessment of the Central Ground Water Authority (CGWA).

Three applicants (Praveen Kakar, J C Kalra and D K Pant) filed an application before the NGT regarding M/s. Ansal Properties and Infrastructure Ltd. alleged encroachment and sale of a substantial part of land - comprising about 45% of the construction project, meant for parks and roads in Sushant Lok, Phase I, Gurgaon. The matter related to the complaint that Express Builders and Promoters Private Limited does not possess a prior Environment Clearance as mandated under Clause 2 of EIA Notification, 2006 and the entire housing project 'Express Zenith, Plot No. GH-02A, Sector-77, Noida has been constructed and developed without an Environment Clearance.
