Order of the National Green Tribunal in the matter of Vivek Kamboj & Others Vs Union of India & Others dated 05/03/2019 regarding setting up of solid waste processing facility, Gurgaon, Haryana. Damage to environment is taking place by contamination of ground water on account of leachate discharge. Wildlife and inhabitants are being affected in terms of health by air pollution, by burning of waste or foul smell for which penal action including prosecution and recovery of actual damages are required, apart from remedial measures.

According to the original application which was filed before this Tribunal on 16.09.2015, solid waste was being dumped in an open site in Aravali forest. Leachate generated was flowing to the seasonal water bodies contaminating the ground water and polluting the surface water.
