The issue in these applications is whether the leased areas of the lessees in question fall within the Revenue land or Forest land. The High Court of Karnataka in its order dated 16/11/2018 sets aside the notifications under the Karnataka Forest Act, 1963, dated 4.8.1994 and 4.9.2014 which according to the State of Karnataka go in support of the claim of the lessees to allow them to commence mining in the leased areas.

The grievance of the applicant is that the project called ‘SJR Watermark Project’ on the bank of Kaikondrahalli Lake in Bengaluru was within less than 10 meters from the edge of the lake as against the requirement of distance of 30 meters which is a buffer/no development/no construction Zone.

The grievance in this application is the order of State of Karnataka dated 18.11.2016 under the provisions of Karnataka Minor Mineral Concession Rule, 1994 permitting use of JCB for sand mining and permitting instream sand mining at the base of the river is in conflict with the Sustainable Sand Mining Management Guidelines, 2016 issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC).
