New Ark Project proceeding with a project without mandatory requirement of environmental clearance. The project consists of high-rise residential apartments and a commercial complex. The project involves extraction of ground water, generation of waste, generation of effluents, pollution of water streams, adverse population density and increased vehicular emissions. The project is in the catchment area of Bellandur and/or Varthur Lakes.

Order of the National Green Tribunal in the matter of Sarvabhoum Bagali Vs. State of Karnataka & Others dated 20/08/2018. The grievance in this application is the order of State of Karnataka dated 18.11.2016 under the provisions of Karnataka Minor Mineral Concession Rule, 1994 permitting use of JCB for sand mining and permitting instream sand mining at the base of the river is in conflict with the Sustainable Sand Mining Management Guidelines, 2016 issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC).

The question raised in this Application is whether the industry in question Josodhapur Industrial Area, Kotdwar, Pauri Garhwal requires environmental clearance and whether such clearance has been given. Further question is whether they are creating pollution without taking requisite precautions by way of installing pollution control equipments and also question about the solid waste disposal.
