NGT directs M/s Lubok Caron LLP to approach the RIICO / Industrial Department State of Rajasthan for alternate site to be allotted. The Tribunal also cautioned that disposal of the tyres of automobiles is also an environmental concern and it will be the duty of the state to ensure that proper disposal facility is created for the said purpose.

Counsel appearing for the State of Rajasthan submits that there is a pipeline that has been laid which carries the effluents. NGT directs production of DPR (Detailed Project Report) that was prepared and the data that was collected for the purposes of determining what should be the gradient size of the pipeline; the kind of effluents was it required to carry and to which end.

The sum and substance of the case is that the scientific reports of IIT Kanpur, the DPCC and CRRI Report of 2002 brings to surface the ill-effects of fossil fuel as compared to diesel emission on the ambient air quality.
