History of the Case: 

Order of the National Green Tribunal in the matter of Central Pollution Control Board Vs State of Andaman & Nicobar & Others dated 22/07/2019 regarding implementation of Plastic Waste Management Rules, 2016 (PWM Rules) and directions issued by the CPCB on 30.06.2016 to implement the thickness norms for carry bags, constitution of squads for vigilance, preventing littering of plastic waste in public, submission of annual reports and action plan for management, quantification and characterization in every city/town of all the States/UTs.

Order of the National Green Tribunal in the matter of Ashwani Kumar Dubey Vs Union of India & Others dated 19/07/2019. The matter of discussion was the Report of the Committee in O.A 164/2018 with I.A. No. 155/2019 for direction dispensing the implementation of the Core Committee’s Recommendation. I.A. No. 337/2019 for permitting the applicant to continue to transport coal by road & I.A. No. 384/2019 for quashing the recommendation of the Core Committee.

The issue for consideration is compliance of the judgment by the Supreme Court in M.C. Mehta vs. Union of India & Ors: (2004) directing shifting/closing of industrial activities falling under category ‘F’ of the Master Plan of Delhi, 2001. Aggrieved by the inaction of the authorities on the subject, petitions were filed in the Delhi High Court alleging that unauthorized industrial activities which included handling of plastic and its illegal disposal by way of burning, etc. were continuing. The proceedings were transferred to the Tribunal.
