From the status reports and affidavits that have been filed NGT notes that it is evident that illegal mining of minor minerals has been carried on mechanically and also through suction pumps put into the water body quite near to the railway track.

In response to an application under RTI Act, information has been given that there are 118 illegal mining operation in the area in question.

With regard to implementation of MSW Rules, 2016 in the Ghaziabad Area, the Commissioner of Ghaziabad Nagar Nigam submits that it was resolved that the Ghaziabad Development Authority will identify suitable land in one patch sufficient for establishment of MSW management plant.

National Green Tribunal directs the Uttar Pradesh Pollution Control Board to examine the said plants and submit a Report to the Tribunal before the next date of hearing (23/03/2017).

According to the Applicant Sanjay Kumar there are 21 hot mix /ready mix concrete plants operating illegally and without consent of the State Pollution Control Board. They were emitting highly polluting ambient air quality in the area in question.
