Counsel appearing for and Ministry of Environment, Forest and Climate Change have brought to the Court's notice that the Notification dated 7th October, 2016 has been issued by the Ministry of Water Resources, River Development and Ganga Rejuvenation which provides for protection of flood plain, fixation thereof and the activity which can be carried out in the flood plain.

Order of the National Green Tribunal in the matter of Sumitra Devi & Others Vs. CPCB & Others dated 02/02/2017 regarding pollution at the industrial complex at Bhiwadi, Rajasthan.

The report of the Joint Inspection Team shows serious pollution of soil, ground water and constituents of the effluent that is being discharged to the CETP. The CETP is non-performing and in any case there is nothing on record to show that it is capable of treating the metallic effluent, as specified in the Report of Joint Inspection Team.

The Petitioners Resident Welfare Association of Sukhdev Vihar, Jasola Vihar, and Ishwar Nagar had approached the High Court of Delhi by filing Public Interest Litigation under Article 226 of the Constitution of India praying that the construction of the proposed Waste to Energy plant close to Okhla STP should be stopped.

Bird’s View Resort & Others dated 30/01/2017 regarding unauthorised constructions in Kasauli area, Solan, Himachal Pradesh. Advocate General appearing for the State has pointed out before the Court detailed list of unauthorized constructions, wholly or partially as well as the authorized construction existing in that area.

Order of the National Green Tribunal in the matter of Suo Motu Uttarakhand Human Rights Commission Vs. Chief Secretary, Govt. Of Uttarakhand & Others dated 27/01/2017 regarding pollution of river Kausi and Ganga, Uttarakhand. Counsel appearing for the State of Uttarakhand would take clear instructions in relation to allocation/allotment of the land for the purposes of establishment of the STPs and Municipal Solid Waste sites.

Order of the National Green Tribunal in the matter of M.C. Mehta Vs. Union of India & Others dated 25/01/2017 regarding Ganga pollution. NGT observed that by different Orders passed by the Tribunal "we had directed all the stakeholders to put forward their submissions/suggestions in regard to the 30 drains which join river Ganga and which cause all major pollution in Segment-B of Phase-I, but we regretfully note that the assistance provided to the Tribunal in that behalf is far from what is desired."

NGT directed the Jammu & Kashmir Government that within one week it should bring complete and comprehensive action plan to ensure handing of municipal solid waste in accordance with Solid Waste Management Rules 2016. The State was entitled to have its opinion with regard to stakeholders who would establish Waste to Energy or Waste to Bio-methane and RDF to Power Plants.
