Counsel appearing for and Ministry of Environment, Forest and Climate Change have brought to the Court's notice that the Notification dated 7th October, 2016 has been issued by the Ministry of Water Resources, River Development and Ganga Rejuvenation which provides for protection of flood plain, fixation thereof and the activity which can be carried out in the flood plain.

The report of the Joint Inspection Team shows serious pollution of soil, ground water and constituents of the effluent that is being discharged to the CETP. The CETP is non-performing and in any case there is nothing on record to show that it is capable of treating the metallic effluent, as specified in the Report of Joint Inspection Team.

The Petitioners Resident Welfare Association of Sukhdev Vihar, Jasola Vihar, and Ishwar Nagar had approached the High Court of Delhi by filing Public Interest Litigation under Article 226 of the Constitution of India praying that the construction of the proposed Waste to Energy plant close to Okhla STP should be stopped.

Order of the National Green Tribunal in the matter of M.C. Mehta Vs. Union of India & Others dated 25/01/2017 regarding Ganga pollution. NGT observed that by different Orders passed by the Tribunal "we had directed all the stakeholders to put forward their submissions/suggestions in regard to the 30 drains which join river Ganga and which cause all major pollution in Segment-B of Phase-I, but we regretfully note that the assistance provided to the Tribunal in that behalf is far from what is desired."

NGT directed the Jammu & Kashmir Government that within one week it should bring complete and comprehensive action plan to ensure handing of municipal solid waste in accordance with Solid Waste Management Rules 2016. The State was entitled to have its opinion with regard to stakeholders who would establish Waste to Energy or Waste to Bio-methane and RDF to Power Plants.
