The High Court of Karnataka on Wednesday took the State government to task on its apathy in protecting the forest area in sensitive zones and ordered a stay on the construction of two mini hydel projects.

During the hearing of a petition filed by Prashanth Yavagal and Western Ghats Environment Forum, challenging the permission accorded to set up mini hydel projects in the Western ghats, the Division Bench headed by Justice D V Shylendra Kumar observed that the government was the number one enemy when it came to protection of forests.

The Karnataka High Court on Monday issued notices to the Centre as well as the State government for allegedly damaging River Phalguni near Mangalore.

The Division Bench comprising Justice D V Shylendra Kumar and Justice K Govindarajulu issued the notices while hearing a public interest litigation filed by Pius Arun D’ Souza and others from Melakoppala and Attrebel villages in Mangalore.

Sounding a note of caution, about the adverse impact of underwater sand mining, Chief Justice Madan B. Lokur asked the advocate-general to seriously reconsider its policy on allowing it. The Chief Justice was hearing a batch of writ petitions on sand mining along with Justice P.V. Sanjay Kumar. The High Court had put a ban on sand mining across the state with effect from April 1 and the state government had filed an appeal, urging the court to lift the ban.

Bench directs PWD to file a status report by April 24

A public interest litigation petition has been filed in the Madras High Court Bench here seeking a direction to forbear the Public Works Department (PWD) and Collectors of Karur, Tiruchi, Thanjavur, Nagapattinam and Tiruvarur districts from quarrying sand along the stretches of rivers Cauvery and Kollidam.
