The court said that the action taken by the Rajasthan State Pollution Control Board is inadequate - while prosecution has been initiated against the municipal council, compensation has not been assessed and recovered.

Grievance in the application is against discharge of untreated effluent by Triveni Sugar Mill at Khatoli, district Muzaffarnagar, Uttar Pradesh, resulting in contamination of groundwater in the area of about one and a half kilometers and upto depth of 50 meters. This has affected the health of the inhabitants and the inhabitants are not able to access potable water.

The issue for consideration is permissibility of operation of hot mix plants at Noida beyond ‘carrying capacity’ of the ambient air of the area as per assessment of the statutory regulators – the Central Pollution Control Board (CPCB) and the Uttar Pradesh Pollution Control Board, thereby adversely affecting the environment and the public health.
