The National Green Tribunal has said that it is no longer mandatory for the Ministry of Environment and Forests (MoEF) to refer to Gadgil panel’s report while deciding applications for clearance for projects in permissible areas of the western ghats.

Nearly 14076 trees are to be uprooted or felled for carrying on this project. Most of these trees are fully grown up trees i.e. of an age of 20 years plus and as such uprooting of these trees would have immediate serious impact on environment.

Order of the National Green Tribunal in the matter of Omesh Saigal V/s Govt. of NCT of Delhi & Ors. dated 11/11/2013. The order mentions that the Delhi Pollution Control Committee (DPCC) in its report says the road side noise level in a locality in Delhi is beyond the permissible limit. However, NGT says the report does not contain the status about the noise level near the residential colony. Accordingly, it directs the DPCC to file further report regarding the noise level which is in existence in the locality concerned.

It takes into account the letter of the CPC Board officials on the issue

National Green Tribunal has intervened and stayed operations of stone quarries of a private company, which were allegedly causing much environmental pollution in Kidigam panchayat under Kashinagar Police Station limits in Gajapati district.

The high court has amended its decision not to hear ‘green’ cases and has clarified that it will continue to hear cases already pending before it, while new cases will be decided on a case-by-case basis.

It was decided earlier that the high court will not hear 45 types of cases related to environmental issues, but would refer them to the National Green Tribunal’s (NGT) regional bench in Chennai.

Even as the high court’s decision on allowing a National Green Tribunal circuit bench here is pending, the court clarified on Wednesday that it would not hear 45 types of cases related to environmental issues.

With the court adopting such a stance, litigants in these 45 types of cases will have to travel to Chennai for grievance redressal before the National Green Tribunal’s regional bench there, which is expected to drive up the cost of litigation significantly.
