Case set out by the appellants is that Madhya Pradesh Sand Mining Rules, 2019 were introduced on August 30, 2019 by Madhya Pradesh wherein every districts, it was required to have its own contractor or a group of contractors to carry out sand excavation from the declared and demarcated sand queries.

The issue for consideration is remedial action against illegal sand mining, in violation of environmental norms, by M/s. R.S.I. Order of the National Green Tribunal in the matter of Rohit Kumar Vs State of Bihar dated 11/02/2022.

Grievance in the application is against illegal sand mining on the bank of Dakhner river near Paraiya (Gaya), Gaya-Rafiganj Road, Bihar, adversely affecting the environment. The applicant has filed photographs and mentioned coordinates of the location of illegal mining.

The appeal filed in the SC challenged the National Green Tribunal (NGT) order, October 14, 2020 in O.A. No. 40/2020/EZ with O.A. No. 57/2020/EZ.
