The matter relates to the notification issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC) March 28, 2020 (S.O.1224 E) that exempted certain activities from obtaining prior environmental clearance (EC).

The excavation of minerals was being done without having due clearances and other relevant consents as per laws.

This new WRI report estimates that legal and illegal mining in the Amazon now cover more than 20% of Indigenous lands – over 450,000 square kilometers. It also finds that Indigenous lands with mining experienced higher incidences of tree cover loss than on those without – at least three times greater in Bolivia, Ecuador and Peru.

The case relates to illegal mining of laterite stone by rat hole mining method without following the standard operating procedures (SOP) for mining and other environmental laws. It was stated that there are at least 40 different sites at Khordha district of Odisha, where such mining is going on that covers 500 acres bringing within it several villages namely Tapanga, Anda and Jhinkijhari under Nijigarh Tapang panchayat.

HIL stated that the Department of Mines & Geology, Government of Jharkhand compliance report of August 9, 2020 had proceeded on an incorrect and baseless assumption that safety measures for restitution of the asbestos mines in Roro hills, Chaibasa, West Singhbum - to mitigate environmental and health impact were not taken.
