Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Ankur Sharma Vs Union of India & Others dated 11/04/2022.

The matter related to old vehicles like Ambassador cars playing on the roads in and around the vicinity of Kolkata and Howrah guzzling petrol/diesel fumes and adding to the worsening air quality.

The NGT directed the state government to file an affidavit within four weeks stating what plans it has framed for such Ambassador cars to bring them within the environmental regimen.

Amicus Curiae stated that BS-VI diesel light and heavy-duty vehicles used for public utility and essential services may be permitted to be registered or in the alternative applicants can approach the Air Commission with a request for a registration.

Grievance in the application is against failure to take remedial action against dust and noise pollution arising out of illegal business of building material and use of heavy machinery like cranes, earth movers, trucks, dumpers, trailers and tractors at plot no. 1 in village Pul Pehlad Pur, South-East district, New Delhi and Badarpur Market, main Mathura Road, near Tughlakabad Metro Station, Badarpur, New Delhi.
