Judgment of the Supreme Court of India in the matter of K T V Health Food Pvt Ltd. Vs Union of India & Others dated 01/02/2023.

The Supreme Court upheld the decision of the National Green Tribunal, Southern Zone which set aside the ex post facto clearance granted by the Union government to K T V Health Food and KTV Oil Mills (one of the largest edible oil companies in South India) for its edible oil storage and transit terminal. 

Objections to the report of the Joint Committee (November 20, 2021) and Andhra Pradesh Pollution Control Board report (November 17, 2021) on behalf of Krishna Oil and Fats Private Limited. The matter related to discharge of effluents by edible oil refineries set up in Krishnapatnam region wherein South India Krishna Oil and Fats Pvt. Ltd. is also one of the respondents. The unit is fully compliant with all existing applicable laws and standards prescribed by the various pollution control regulatory bodies.

Action taken report in the matter of Original Application No. 221/2015 submitted to the National Green Tribunal, Southern Bench, Chennai in compliance to the NGT order, September 16, 2021. Seven edible oil industries are operating in Krishnapatnam Port region in SPSR Nellore district.

The applicant, Isanaka Vedavathi submitted a representation stating that pollution has been caused by edible oil units. The NGT, Southern Bench vide order, March 16, 2020 appointed a joint committee to ascertain the status of functioning of edible oil refinery units at Krishnapatnam.
